1. Acceptance of Terms

By accessing or using Almeda, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the service. You must be at least 13 years old to use Almeda.

2. Service Description

Almeda provides automated video clipping, editing, and publishing tools for live streamers. The service captures replay buffer footage via a local agent application, processes it in the cloud using AI-powered transcription and editing tools, and optionally publishes to connected social media platforms on your behalf.

3. Account Responsibilities

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must provide accurate information when creating your account and keep it up to date. You agree to notify us immediately if you become aware of any unauthorized access to your account.

You are responsible for the social media accounts you connect to Almeda. When you authorize Almeda to post on your behalf, you are responsible for ensuring the content complies with the terms of each connected platform.

4. User Content

You retain ownership of all video content you upload to Almeda. By using the service, you grant us a limited, non-exclusive license to process, store, and transmit your content solely for the purpose of providing the service. This license terminates when you delete your content or your account. You are responsible for ensuring you have the rights to any content you upload.

5. Acceptable Use

You agree not to use Almeda to upload or distribute content that is illegal, infringing, harmful, defamatory, or violates the terms of connected platforms. You may not use the service to spam, harass, or distribute malware. You may not attempt to reverse engineer, exploit, or interfere with the operation of the service. We reserve the right to suspend or terminate accounts that violate these terms.

6. Third-Party Platforms

Almeda integrates with third-party platforms including YouTube, TikTok, Instagram, X, and Twitch. Your use of these platforms through Almeda is subject to their respective terms of service and privacy policies:

By using Almeda's YouTube publishing features, you agree to be bound by the YouTube Terms of Service. Your use of other connected platforms is subject to their respective terms of service and privacy policies.

Almeda posts content to these platforms on your behalf using authorized OAuth connections. You are solely responsible for the content you publish through these integrations and for complying with each platform's community guidelines and content policies. Almeda is not responsible for actions taken by these platforms regarding your content or account.

7. Subscriptions and Billing

Paid plans are billed through Stripe. You can cancel your subscription at any time from your account settings. Upon cancellation, you retain access to your paid plan until the end of the current billing period. Refunds are handled on a case-by-case basis. Free tier limits apply as described on the pricing page.

8. Intellectual Property

The Almeda service, including its software, design, branding, and documentation, is owned by Almeda and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the service. The Almeda name, logo, and associated marks are trademarks of Almeda. Nothing in these terms grants you a license to use our trademarks without prior written consent.

9. Termination

You may delete your account at any time from your account settings. We may suspend or terminate your account if you violate these terms, engage in abusive behavior, or fail to pay for a subscription. If we terminate your account for a violation, we will provide notice and, where reasonable, an opportunity to export your data.

Upon termination, your license to use the service ends immediately. We will delete your account data, video files, and clip outputs within 30 days. Provisions that by their nature should survive termination (including limitation of liability, intellectual property, and governing law) will continue to apply.

10. Limitation of Liability

Almeda is provided "as is" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or that all publishing operations will succeed. We are not liable for any lost content, failed uploads, publishing errors, or actions taken by third-party platforms. Our total liability is limited to the amount you paid for the service in the preceding 12 months.

11. Governing Law

These terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles. Any disputes arising from these terms or your use of the service will be resolved in the state or federal courts located in Wyoming. You agree to submit to the personal jurisdiction of these courts.

12. Changes to Terms

We may update these terms from time to time. We will notify you of significant changes via email or in-app notification at least 14 days before they take effect. Continued use of the service after changes constitutes acceptance. If you disagree with updated terms, you may delete your account before they take effect.
